What Is Legitimation?

Under O.C.G.A. § 19-7-22, a father must petition the Superior Court to legitimate his child. Without legitimation, an unmarried father has no legal rights to custody or visitation — even if he is listed on the birth certificate.

  • Step 4: If the mother objects, a hearing will be held to determine if legitimation is in the best interest of the child.
  • Step 5: The court enters an Order of Legitimation, establishing the father's legal rights.

Legitimation vs. Paternity

Many people confuse legitimation with paternity. Establishing paternity (proving biological fatherhood) is not the same as legitimation. A DNA test or Voluntary Paternity Acknowledgment establishes biological fatherhood but does not grant legal parental rights. Only legitimation through the court grants full legal parental rights in Georgia.

Custody and Visitation After Legitimation
