Grounds for Divorce
In Georgia there are 13 grounds on which you can file for a divorce. There are the general no-fault "irretrievably broken" grounds for divorce, and then 12 other grounds which may require evidence to prove unless your spouse agrees. The most common ground used is that the marriage is irretrievably broken.
The Divorce Documents
Georgia, like most states, only requires a Summons and Complaint to initiate a divorce action. The law requires the complaint be sworn to or verified. How to File & Serve the Divorce Paperwork
Any action can be filed in-person at your local Superior Court. There is a required filing fee paid to the clerk's office at the time of filing. The fee in GA is between $200 and $230. You also have the option of filing online via Odyssey or Peachcourt. Once filed, your spouse will need to be served with the papers.
How Long Will It Take to Divorce?
Typically, an uncontested divorce can be finalized any time after 31 days of properly filing and serving the divorce documents. Contested divorce can take months or years to finalize.
